You agree that by your use of the JBF Site constitutes an agreement by you to comply with, follow and be bound by the following terms and conditions: (1) Unless otherwise noted, all materials, including the text, photographs, designs, graphics, logos, icons, images, symbols, audio clips, visual clips, software, illustrations, source codes and all other materials in and on the JBF Site or obtained by or through the JBF Site (“Contents") are covered by the federally protected copyrights, trademarks, service marks, trade dress and other intellectual property rights owned by JBF; (2) No Contents may be copied or used for any purposed without the prior written consent of JBF; (3) All franchisees of JBF are granted a limited right to review and use the Contents of the JBF Site solely in accordance with and only to the extent permitted by their respective Franchise Agreements; (4) No person, including JBF Franchisees, have a right to copy, reproduce, duplicate, distribute, down load, change, modify or otherwise use the Contents in any capacity or to sell or grant any right of use in the Contents without the prior written consent of JBF; (5) Any unauthorized use of the Contents without the prior written consent of JBF constitutes a violation of JBF’s right, titles and interests in the Contents and terminates any authorized right and consent by JBF; (6) The terms “Just Between Friends,” “Between Friends,” “JBF” and the related commercial symbols are registered trademarks and/or service marks owned by JBF Any unauthorized use of JBF’s marks violates JBF’s rights and may entitle JBF to actual, punitive and special damages, injunctive other relief.
